Yz Dream respects intellectual property rights and expects users to do the same. This policy explains how to submit a DMCA notice of alleged copyright infringement relating to content hosted or displayed on our website, store, or within the Yz Dream – Digital Car Management App (the “Service”), and how a user may submit a counter-notice.

Note: To qualify for certain U.S. “safe harbor” protections under the DMCA, service providers must also register their designated agent with the U.S. Copyright Office. Yz Dream follows a DMCA-style process and will also comply with applicable EU/Italian law.

1) What this covers

  • Content you or your team upload/store in the Service (e.g., vehicle photos, brochures, documents).
  • Content on our public pages (e.g., images, text) if you believe we inadvertently used your copyrighted work.

We may remove or disable access to allegedly infringing material and may terminate repeat infringers’ accounts.

2) How to submit a DMCA notice

To request removal/disablement under the DMCA (17 U.S.C. §512(c)(3)), send a written notice to our DMCA Agent containing all of the following:

  1. Your signature (physical or electronic).
  2. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered.
  3. Identification of the infringing material (or the subject of the infringing activity) to be removed or disabled — provide specific URLs or in-app locations sufficient for us to find it.
  4. Your contact information: full name, mailing address, telephone, and email.
  5. Good-faith statement: “I have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”
  6. Accuracy & authority statement: “The information in this notification is accurate, and under penalty of perjury, I am the copyright owner or authorized to act on behalf of the owner.”

Privacy note: We will forward your notice (including your contact details) to the user who uploaded the material so they can submit a counter-notice.

3) What happens after we receive a notice

  • We will acknowledge receipt and review the notice for completeness.
  • If complete, we may remove or disable the material and notify the user who posted it.
  • We may request additional information to verify your claim.
  • If we remove/disable content, we will retain a record of the notice and our response.

4) How to submit a counter-notice (if your content was removed)

If your material was removed under a DMCA notice and you believe this was a mistake or misidentification, you may send a counter-notice (17 U.S.C. §512(g)) to our DMCA Agent containing all of the following:

  1. Your signature (physical or electronic).
  2. Identification of the removed or disabled material and the location where it appeared before removal.
  3. Good-faith statement: “I have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.”
  4. Your name, address, telephone, and email, and a statement that you consent to the jurisdiction of:
    • the U.S. Federal District Court for the judicial district where your address is located, or if outside the U.S., for any judicial district in which Yz Dream may be found; and that you will accept service of process from the person who filed the original notice or their agent.

Restoration: If we receive a valid counter-notice, we may restore the material 10–14 business days after forwarding it to the original complainant, unless that party informs us they have filed court action seeking to restrain you from infringing the work.

5) Repeat infringers

In appropriate circumstances, Yz Dream may terminate accounts of users who are determined to be repeat infringers. We may also limit features or access while we investigate.

6) Misuse & 512(f) warning

Submitting a false claim or counter-claim can carry legal consequences. Under 17 U.S.C. §512(f), anyone who knowingly misrepresents that material or activity is infringing (or was removed by mistake) may be liable for damages, including costs and attorneys’ fees.

7) Other rights and laws

Yz Dream may remove or disable content at its discretion even without a formal DMCA notice if we reasonably believe it infringes IP rights or violates our Terms. We also comply with applicable EU/Italian laws on notice-and-action for illegal content.
